TERMS OF SERVICE FOR TEACHASSIST

1. ACCEPTANCE OF TERMS

By downloading, installing, or using TeachAssist ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. DESCRIPTION OF SERVICE

TeachAssist is a free, open-source mobile application that provides a mobile interface for accessing ta.yrdsb.ca. The App is developed by an individual developer and is distributed under the MIT License. The App does not collect, store, or transmit user data to any external servers operated by us.

3. OPEN SOURCE LICENSE

TeachAssist is released under the MIT License. The source code is available for review, modification, and distribution in accordance with the MIT License terms. You may freely use, copy, modify, and distribute the software, subject to the MIT License conditions.

4. USER RESPONSIBILITIES

Account Security:

  • - You are solely responsible for maintaining the confidentiality of your ta.yrdsb.ca login credentials
  • - Do not share your username and password with others
  • - You are responsible for all activities that occur under your account
  • - Notify us immediately of any unauthorized use of your credentials

Acceptable Use:

  • - Use the App only for its intended purpose of accessing your educational information
  • - Do not attempt to hack, reverse engineer (beyond what's permitted under open source), or exploit the App
  • - Do not use the App for any illegal activities
  • - Do not attempt to access accounts that do not belong to you
  • - Do not use automated systems or bots to access the App excessively
  • - Do not interfere with or disrupt the App's functionality

5. DATA ACCURACY DISCLAIMER

  • - You acknowledge that TeachAssist displays information from ta.yrdsb.ca
  • - We make no representations about the accuracy, completeness, or timeliness of any information displayed
  • - It is your responsibility to verify all information with official sources
  • - Any discrepancies should be resolved directly with your educational institution
  • - We are not responsible for any consequences arising from inaccurate or outdated information

6. THIRD-PARTY SERVICES

  • - The App interfaces with ta.yrdsb.ca, which is operated by York Region District School Board
  • - We have no control over ta.yrdsb.ca's availability, functionality, or content
  • - Your use of ta.yrdsb.ca through our App is subject to their terms of service and privacy policies
  • - We are not responsible for any issues, outages, or changes to ta.yrdsb.ca
  • - The App will attempt to notify users of connectivity issues, but we cannot guarantee such notifications

7. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  • - Attempting to gain unauthorized access to other users' accounts
  • - Using the App to harass, threaten, or harm others
  • - Distributing malware or harmful code through the App
  • - Attempting to overwhelm ta.yrdsb.ca's servers through excessive requests
  • - Using the App in violation of any applicable laws or regulations
  • - Impersonating others or providing false information
  • - Commercial use without explicit permission

8. TERMINATION

  • - We reserve the right to terminate or suspend your access to the App at any time for violation of these Terms
  • - You may stop using the App at any time by uninstalling it from your device
  • - Upon termination, all locally stored data will be deleted when you uninstall the App
  • - Termination does not affect your rights under the MIT License for the source code

9. DISCLAIMERS AND WARRANTIES

NO WARRANTY:

  • - THE APP IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND
  • - WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • - WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM HARMFUL COMPONENTS

LIMITATION OF LIABILITY:

  • - TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP
  • - YOU ASSUME ALL RISKS AND LIABILITY FOR YOUR USE OF THE APP
  • - OUR LIABILITY, IF ANY, SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO, AS THE APP IS FREE)

10. UPDATES AND MODIFICATIONS

  • - We reserve the right to update, modify, or discontinue the App at any time
  • - We may update these Terms from time to time
  • - Continued use of the App after changes constitutes acceptance of the new Terms
  • - We will attempt to notify users of significant changes through the App or app store updates

11. DISPUTE RESOLUTION

Arbitration:

  • - Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration
  • - Arbitration will be conducted in Ontario, Canada, under Canadian arbitration law
  • - You waive your right to participate in class action lawsuits
  • - Small claims court disputes under $25,000 CAD may be pursued in small claims court instead of arbitration

12. INTELLECTUAL PROPERTY

  • - The App is open source under the MIT License
  • - Educational data accessed through the App belongs to you and/or York Region District School Board
  • - We claim no ownership over any educational data accessed through the App
  • - Trademarks and copyrights of third parties are acknowledged

13. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information.

14. GOVERNING LAW

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

15. AGE REQUIREMENT

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement. This age is independently verified and enforced by YRDSB.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. ENTIRE AGREEMENT

By using TeachAssist, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
